Terms of Payment

These Payment Terms (the “Terms”) govern the use of any Credit or Debit Card payments made through the NQC website, currently resolved at app.nqc.com  (the “Platform”). By undertaking a payment on the Platform, you hereby agree to these Payment Terms.

1. Payments

Where applicable, you authorise us to charge the relevant payment method you have provided us for all payments payable or due for a purchase you make from us.

All payments made under these Terms are exclusive of value added tax and any other similar or equivalent taxes, duties, fees and levies imposed from time to time by any governmental or other authority, which will be payable by you in addition to any other sums in the manner and at the rate prescribed by law from time to time.

You acknowledge and accept that, when making a payment, you may incur foreign transaction fees, credit card fees and other related charges as determined by your bank or card issuer. We are not responsible for these fees. You agree to pay all such fees independently of your purchase of an Assessment.

For the avoidance of doubt, all payments will be made in full and without any deduction, withholding or set-off.

You acknowledge and agree that we may increase any payments for the purchase of an Assessment.

Except as otherwise agreed by us in writing and at our sole discretion, no refunds shall be made to you with respect to any p or Debit Card payments made through the Platform.


2. General

NQC offers an online cyber assessment and vulnerability scan service herein referred to as CYBERSAFE CHECK. CYBERSAFE CHECK is an annual service which allows Users to conduct a vulnerability scan for a defined IP address/web domain and complete an online cyber assessment once every month for a 12 month period. If a User chooses to purchase CYBERSAFE CHECK, beyond any trial or free period that may be offered, the provisions of these Payment Terms will apply.

These Payment Terms and any disputes or claims arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be exclusively governed by, and construed in accordance with, English law, without regard to conflicts of laws principles. You agree that the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Payment Terms or their subject matter or formation.
